I don't believe they have a choice .... if, as I understand to be the case,
there is a statute of limitations type provision in the laws pertaining to
intellectual property, Microsoft would be bound by that.  Some of us hold
certain opinions in respect of the 'equality' of justice in legal processes,
however in cases where the intent of the law is quite explicit (as appears
to be the case here) & doesn't leave itself open to 'interpretation',  I
believe it would require more than a decision by a competent judge to change
the law for the benefit of William & Co. Maybe someone legally qualified &
knowledgeable in the area of 'intellectual property' could enlighten us
further ??
