We have been here before look in the old mailing lists.
The ACA is happy to talk to anyone, and there legal department is very 
accessible .
The issue with routing traffic is based on the telecommunications act 
1997
In the act see section 23 to find the definition of immediate circle.
The act can be found here , http://scaleplus.law.gov.au select browse all 
data, and then select the entry next to pasteact. The "Telecommunications 
Act" can be found under the Te link.
This link should be hosted somewhere on melbwireless as it is a critical 
reference for this group.
If you ask the ACA they will tell you that a members of a group ( 
read:immediate circle ) can route other members data.
The members cannot without a licence route data from others external to 
the group ( read:immediate circle ). They were a little vague on the 
implications if the other party did not pay for the privilege.
So before you all get carried away and call every lawyer in town for an 
interpretation that may not be that of the ACA I suggest phoning the ACA 
on 03 9963 6988 and ask for their legal department, and get the real 
answer to you questions.

There is a very good IT/IP lawyer in melbourne by the name of Steve 
White,  I'll have to dig out his details later tonight at home.  He has 
helped me with alot of IP work and I think he's done the odd bit freebee 
work aswell...

One approach would be to request an information paper direct from the ACA
spelling out what "open source" wireless networks are and are not allowed 
to
do.
The ACA does publish information papers by request, but I'm not sure what
sort of power and influence the group requesting the paper must carry.
