I know this is old and has been talked about before, but I didn't read into
it enough so sorry if this is old news.
Short story is that 5.725 - 5.850 GHz WLAN equipment is ok for outdoor use,
but 5.150 - 5.350 GHz gear is not!

Item 45B of the Radiocommunications (Low Interference Potential Devices)
Class Licence 2000 permits the operation of digital modulation transmitters,
including WLANs, outdoors. The permitted frequency range is 5725-5850 MHz
and the maximum EIRP is 4 W. The following limitations also apply to these
transmitters:
1. The radiated peak power spectral density in any 3 kHz is limited to 25 mW
per 3 kHz.
2. The minimum 6 dB bandwidth must be at least 500 kHz.
WLANs operating in the 5150-5350 MHz range are not permitted to be used
outdoors. A copy of the Class Licence is available from the ACA website at
http://internet.aca.gov.au/acainterwr/aca_home/legislation/radcomm/class_lic
ences/lipd.rtf.
